The Incident: In June 2023, Heather M. was sitting in her car in the parking lot of a Bel Air grocery store in Sacramento. Without warning, a dump truck sped into view and struck Heather’s car, crushing it and almost killing her. With massive internal injuries to nearly every major organ, including irreversible kidney damage, Heather spent a total of 87 days in the UC Davis ICU and hospital. Her recovery will never be complete; Heather requires kidney dialysis, a procedure that takes several hours, multiple times per week.
Challenges: Complicating the situation, the dump truck had no license plates, and the driver of the dump truck fled the scene. Bel Air was unwilling to share security footage with anyone but law enforcement.
Our Approach: Heather retained E&T personal injury attorney Seth Bradley. Mr. Bradley secured security footage from a tire shop across the street from the incident scene. Then he alerted a detective, who secured a copy of the footage before it was deleted per company protocols. Without plates, it was impossible to identify the registered owner. So, Mr. Bradley turned to the media. He contacted a local TV station, which agreed to air the footage and an interview with the victim’s brother. Almost immediately, tips came in; the owner of the dump truck and the driver were eventually identified and contacted.
The Result: Due to the limited finances of the dump truck owner, accepting an offer from his insurance company for their $ 1,000,000 policy limits for the collision made the most sense for Heather and her husband.
